Preliminary hearing set for Lyndon man accused of indecent liberties with a child

A Lyndon man being held in the Osage County Jail on $100,000 bond will face a preliminary hearing Thursday on charges of aggravated indecent liberties with a child and lewd and lascivious behavior.

The Osage City Police Department arrested Christopher A. Gillham, 25, of rural Lyndon, on the charges June 28, at an Osage City residence.

A complaint filed by Osage County Attorney Brandon Jones alleges that on or about May 19, 2014, Gillham unlawfully had sexual intercourse with a child older than 14 years but younger than 16; and exposed himself in the presence of a person who was not his spouse and a person younger than 16 without consent and with the intent of sexual gratification.

The preliminary hearing is scheduled for 3 p.m. July 31 in Osage County District Court.

OCPD also served a warrant on Gillham for failure to appear in a 2013 case in which is he is accused of giving a worthless check. Gillham is also scheduled for an appearance Thursday with his attorney, James Campbell, on that case.

Aggravated indecent liberties with a child is a severity level 3 person felony with a possible penalty of 55 months to 247 months in prison and a possible fine up to $300,000; lewd and lascivious behavior is a severity level 9 person felony with a possible penalty from 5 months to 17 months in prison and a fine up to $100,000. Giving a worthless check is a class A nonperson misdemeanor, with a penalty of up to 12 months in the county jail and a fine of up to $2,500.
